Victor T. Fu, a Managing Partner of the firm, is a senior litigator and head of the Business Litigation Group with decades of experience advancing the interests of a wide range of clients and has been with the firm since its inception. Victor has experience representing private and public companies in all aspects of business litigation from pre-lawsuit through trial and appeals in state and federal courts throughout the United States. He has also represented clients in state and federal administrative proceedings, including those before the California Public Utilities Commission, the Securities and Exchange Commission, the Trademark Trial and Appeal Board and the California Labor Commissioner. He advises companies regarding legal and regulatory compliance including state and federal securities laws, state and federal labor, employment and public accommodation laws (including Americans with Disabilities Act, Unruh Civil Rights Act, California Labor Code, and California Fair Employment and Housing Act), trademark registration and protection and copyright registration and protection.  He also has a wide range of experience counseling clients on employment and other business disputes, and drafting and negotiating business and intellectual property agreements, employment and severance agreements, settlement agreements, independent contractor agreements, employment contracts, employee handbooks and employer policies.

Practice Highlights:

  • Represented investor owned utilities in various proceedings before the California Public Utilities Commission, including General Rate Case Proceedings, and the California state courts;
  • Lead counsel for skincare products company in federal lawsuit against competitor who raided sales team and misappropriated trade secrets. Initial case settled to client’s satisfaction at mediation shortly before trial. After settlement agreement was breached, led arbitration against competitor and received substantial judgment for client, including full attorneys’ fee award;
  • Lead defense of company against former co-founder who alleged claims for fraud, breach of fiduciary duty and unfair competition. Prevailed in arbitration and arbitration award confirmed.
  • Represented private equity group in litigation against sellers over claims of fraud and breaches of representations and warranties in merger/acquisition agreement. Multimillion-dollar settlement reached prior to trial.

 Prior to helping form Prospera Law, Victor was a senior litigator for Richardson & Patel LLP where he specialized in litigating labor and employment, securities, intellectual property claims and various other business disputes.

In his leisure time, Victor enjoys spending time with his wife and three kids and being a rapt audience at his kids’ soccer games and music recitals.  He is also a foodie who is incapable of cooking and an avid viewer of films, television shows and sporting events.

Victor earned his J.D. from Loyola Law School and his Bachelor of Arts degree in Economics, Literature and Film from Claremont McKenna College.  During law school, he spent a semester working full-time as a judicial extern for the Hon. Terry J. Hatter, Jr., Chief Judge of the United States District Court for the Central District of California.
